To support this mission, we have developed a comprehensive series of explainers aimed at equipping Equality Bodies and Civil Society Organisations (CSOs) with the knowledge and tools to navigate AI’s impact on society. 

Understanding Artificial Intelligence: Concepts, Limitations, and Risks 

Our series begins with “Understanding Artificial Intelligence: Concepts, Limitations, and Risks”, authored by Dr. Aaron Ceross which provides a foundational overview of AI concepts, types, and applications. This explainer breaks down various AI systems – from rule-based AI to machine learning, reinforcement learning, and generative models -explaining how each operates, their uses, and their limitations. It also highlights the equality implications of AI, including biases in training data and opaque decision-making processes. 

Explaining ‘By-Design’ Approaches: Principles and Implementation  

The explainer “Explaining ‘By-Design’ Approaches: Principles and Implementation” delves into the core principles and practical implementation of the ‘Equality by Design’ approach. It explores how fairness, inclusivity, and non-discrimination can be systematically integrated into artificial intelligence (AI) systems from the very beginning. The focus is on proactive strategies, meaningful stakeholder engagement, and structured oversight to ensure AI systems contribute to equitable and just outcomes. 

‘Equality by Design’ aims to prevent discrimination before it occurs, thereby making AI systems more trustworthy, inclusive, and socially responsible. However, implementing this approach comes with challenges, including balancing fairness with accuracy, correcting for historical data biases, and adapting to varying equality standards across legal and cultural contexts. 

A Guide for access to justice for Equality Bodies and CSOs: understanding, monitoring and remedying AI-based discrimination  

The explainer “A Guide for Access to Justice for Equality Bodies and CSOs: Understanding, Monitoring and Remedying AI-based Discrimination”, authored by Fabian Lütz, focuses on the practical aspects of accessing justice in cases of suspected algorithmic discrimination.  It offers clear guidance for equality bodies and civil society organizations (CSOs) on how to navigate AI-related discrimination cases, with an emphasis on transparency requirements, individual rights, and public enforcement mechanisms established under the AI Act. 

Under the AI Act, individuals affected by AI systems are granted several rights, including the right to lodge complaints with market surveillance authorities and the right to receive explanations for decisions made by high-risk AI systems. Additionally, they should consider using parallel complaint mechanisms and carefully document any harm suffered in preparation for potential legal action. 

Technical Standards: Opportunities for Equality Bodies and Civil Society Organisations  

The explainer “Technical Standards: Opportunities for Equality Bodies and Civil Society Organisations”, authored by Dr. James MacLaren, clarifies the critical role of technical standards in the regulation of artificial intelligence. It explores how harmonised standards contribute to legal presumptions of compliance with the European Union AI Act (EU AIA) and highlights the importance of involving equality bodies and civil society organisations (CSOs) in the standard-setting process to safeguard fundamental rights. 

Technical standards offer detailed instructions for developers of algorithmic systems on how to fulfill the essential requirements laid out in the EU AIA . Harmonised standards, which are being developed at the moment by European standardisation bodies at the request of the European Commission, are especially significant for high-risk AI systems. These standards provide a presumption of conformity, meaning that AI providers who follow them are considered compliant with the AI Act, thereby streamlining  regulatory compliance . 

By participating in the development of these standards, equality bodies and CSOs can help ensure that the resulting frameworks promote fairness, mitigate bias, and uphold fundamental rights. Their engagement is essential for embedding human rights perspectives into the technical foundations and regulatory oversight of AI systems.
